Trump Prosecutions
D.C. Federal Case - January 6 Allegations
The big news, of course, was that on Monday we finally got the Supreme Court’s decision on presidential immunity. It was worse than I and many others had feared.

Under normal court procedures it will take about a month before the case is returned to Judge Chutkan and she has jurisdiction to move forward. I would expect her to set a status hearing sometime in August to hear from the parties about next steps. That could include hearings in the fall concerning whether particular allegations in the indictment are immune “official acts” that prosecutors will be forbidden to prove at trial.

As I mentioned in Monday’s post, I think there’s a good chance that in the end Judge Chutkan will find that most of the allegations do not refer to official acts and are not immune. But that’s going to take some time to sort out, and then there may be additional appeals. There will most likely not be a trial before the election. The hearings, however, could at least serve to remind the voters of the allegations of the indictment and Trump’s efforts to overturn the election.
